Résumé: ملخص: إن انطباع خصائص الشريعة الإسلامية بشمولها وكمالها، وموافقتها للفطر على منحى المالكية الأصولي؛ اكسب أصولهم الاتساع في اتساق ومرونة، مما مخَّض اختيارات خصوا بها في الأصول، فعدت من مفرداتهم، وكان لها الأثر الجلي في الاختيار الفقهي ببعده النقلي والعقلي، وما هذه الدراسة إلا محاولة لتجلية ما تفردوا به عن غيرهم - الحنفية والشافعية والحنابلة ـ من اختيارات أصولية في باب الحكم الشرعي، وأثرها الفقهي.
