الإهمال العائلي وأثره على جنوح الأحداث

Résumé: يؤدي إهمال العائلة للحدث إلى انحرافه مما يجعله لا يحترم القواعد الدينية والأخلاقية، حيث تدفع جملة من العوامل، منها ماهي أسرية واجتماعية الحدث الى انتهاج الجنوح . ويقصد بالإهمال العائلي هو عدم قيام الوالدين بالتزاماتهم اتجاه أبنائهم، أما المقصود بجنوح الأحداث هو انحراف الحدث وسلوكه سلوكات لا تتناسب مع معايير المجتمع . ويرجع الإهمال العائلي غالبا إلى تفككها سواء كان هذا التفكك ماديا أو معنويا، حيث أثبتت الدراسات أن الأسرة المتصدعة لها دور فعال في تكوين السلوك الإجرامي لدى الطفل. وقد جرم المشرع الجزائري كل الأفعال التي تؤدي إلى جنوح الأحداث وأوردها في المواد 331، 330 من قانون العقوبات، كما أورد جملة من المواد والآليات تحت قانون 15/12 المتعلق بحماية الطفل التي من شأنها حمايته. الكلمات المفتاحية: إهمال عائلي- جنوح-حدث Summary: The family’s neglect of juvenile delinquency leads to its delinquency, which makes it not respect the religious and moral rules. Family neglect is the failure of parents to fulfill their obligations towards their children. As for juvenile delinquency, what is meant by juvenile delinquency is the deviation of the juvenile and his behavior, behaviors that do not fit with the standards of society. Family neglect is often due to its disintegration, whether this disintegration is physical or moral, as studies have shown that the fractured family has an effective role in forming the child's criminal behavior. The Algerian legislator has criminalized all acts that lead to juvenile delinquency and has listed them in Articles 331, 330 of the Penal Code, as well as a set of articles and mechanisms under Law 12/15 related to child protection that would protect him.
