عقود تفويض المرفق العام في التشريع الجزائري

Résumé: نظم المشرع الجزائري،عقود تفويض المرفق العام بصورة صريحة لأول مرة ،بموجب المرسوم الرئاسي 15/247 المتعلق بالصفقات العمومية وتفويضات المرفق العام، ليوحد جميع أنواع التفويضات في نص قانوني جامع بعد أن كانت مشتتة في العديد من النصوص ، ثم صدر المرسوم التنفيذي 18/199 الذي فصل في إجراءات الابرام والتنفيذ في إطار مفهوم بديل وجديد للتعاقد الاداري، تطبعه الشراكة الفعلية بين القطاع العام والقطاع الخاص. يقتضي أسلوب تفويض المرفق العام تحويل تسيير واستغلال مرفق عام إلى مختلف المتعاملين الاقتصاديين، مع شرط احتفاظ السلطة المفوضة بحقها في الاشراف والرقابة من أجل ضمان استمرارية المرفق العام ، و تحقيق جودة ونجاعة الخدمة العمومية. الكلمات المفتاحية: عقد تفويض ،المفوض له، السلطة المفوضة،مرفق عام،منافسة. Abstract: The Algerian legislature has clearly organized contracts for the delegation of public utility, according to the presidential decree n 15/247 to unify all types of mandates in a one text, then the executive dercree n 18/199 was new concept of administrative contracting, distinguished the partenership between the punlic sector and the private sector. This method requires to tranfering the management and exploitation of a public utility to the various economic dealers, with the condition thaht the delegation authority retains its right to control in order to ensure the regular operation of the publicfacility and the continuity and achivement of the quality and efficiency of the public service Keywords:contract of delegation,the delegate, delegated authority,puplic utility,competition
