البلاغة الجديدة لفلسفة القانون: بحث في التشكلات السيميوطيقية والابستمولوجية

Résumé: حاول الفيلسوف ورجل القانون شاييم بيرلمان، في هذا النصّ الأساسي، تسليط الضوء على ذلك الفضاء السيميوطيقي في عملية التشريع القانوني، والذي تتشكل من خلاله ابعاد العلاقة الإشكالية بين الفلسفة؛ والقانون؛ وعلوم اللسانيات؛ والمنطق، وابستمولوجيا العلوم الاجتماعية وعلوم مهارات التفكير والأدراك والكلام، أي أنثروبولوجيا الممارسات الاجتماعية بصورة عامة، وصور تكونها في ظل سيطرة مفاهيم تقليدية في علوم الفلسفة والقانون، نشأت تحت سيطرة النزعات الوضعية؛ والإطلاقيّة والشكلانية. وهذا النصّ هو مقال مُستلّ من كتاب بيرلمان، بعنوان: (العدالة والعقل) الصادر في سنة 1963، تسبقه افتتاحيّة، هي، في الأصل، تمثل مساهمة لبيرلمان في معرض ردّه على تحقيق قامت به مجلة أرشيف فلسفة القانون، الصادرة عن الجمعية الفرنسية لفلسفة القانون، في سنة 1962، والذي كان بعنوان: (ما هي فلسفة القانون؟). ABSTRACT : the philosopher and jurist Chaïm Perelman tried, in this basic text, highlight on that semiotic space in the process of legal act, through which the dimensions of the problematic relation between the philosophy; law; linguistics; logic, the epistemology of social sciences and the sciences of thinking and reasoning, cognition and speech skills, that is means in general, the anthropology of social practices, are formed in various rhetorical figures under the dominance of traditional concepts in the sciences of philosophy and law, which arose as a result of the control of positivism; absolutism and formalism. This text which was an article extracted from Perelman’s book, entitled: (Justice and Reason) published in 1963, preceded by a preface that is originally, represents a contribution to Perelman in his response to an investigation carried out by the Archives of the Philosophy of Law, published by the French Association for the Philosophy of Law, in 1962, which was entitled: (What is the philosophy of law?).
