رد المحكم في التحكيم التجاري الدولي

Résumé: رد المحكم هو منعه من النظر والفصل في قضية التحكيم، بناء على طلب أحد الخصوم لأسباب يخشى أن تخرجه عن حياده، وأن المبدأ يقتضي أن يختار أط ا رف التحكيم المحتكمين، إلا أن المشرع الج ا زئري أجاز رد المحكم و حدد أسباب الرد في المادة 1016 من قانون الإج ا رءات المدنية و الإدارية، حيث نصت مختلف التشريعات على رد المحكم، إذ ما توافرت نفس الأسباب الخاصة برد القضاة تلك الدوافع التي يصبح فيها المحكم غير صالح لإصدار الحكم، إذ من الطبيعي أن يتنحى المحكم عنها بتقريره، و بالتالي فإن لهذا الأخير آثار سواء على المحكمين أو المحتكمين أو لقضية التحكيم.The arbitrator's response is to prevent him from considering and adjudicating the arbitration case, and that the principle requires that the arbitration parties choos the arbitrators, but the Algerian legislature allowed the arbitrato ' s response and specified the reasons for the response in article 1016 of the code of civil and administrative procedure. Where various legislation have reslted in the response of the arbitrator, if there are the same reasons fore the judges ' response, those motives in which the arbitrator becomes unfit to issue a judgment, as it is natural for the arbitrator to recuse himself from them with his report, and therefore the latter has implications both for the arbitrators or arbitrators or for the arbitration case.
