بيع عقار أو الحق العيني العقاري المملوك للمفقود في التشريع الجزائري

Résumé: ملخص: يهدف هذا المقال إلى دراسة بيع الحق العيني العقاري المملوك للمفقود في التشريع الجزائري. فرغم أن قانون الأسرة الجزائري نظم كل ما يتعلق بالمفقود إلا أنه لم يتطرق لإجراءات بيع عقار المفقود. ولم تضبط هذه الإجراءات إلا بعد صدور القانون 08-09 المتضمن قانون الإجراءات المدنية والإدارية لعام2008. وقد تبين من خلال معالجة الموضوع أن هناك بعض الأحكام الدقيقة غفل عنها هذا القانون أيضا مما يستوجب إعادة صياغة بعض مواده تحقيقا لحماية أكبر لأموال المفقود. Abstract: The aim of this article is to study the sale of real estate property rights owned by the missing person in Algerian legislation. Although the Algerian Family Code regulated everything related to the missing, it did not address the procedures for the sale of the property owned by the missing person. These measures were not established until after the enactment of Law 08-09, containing the Civil and Administrative Procedures Act 2008. It has been shown through the analysis of the subject that there are some precise provisions that are also absent from this law, which necessitates the reformulation of some of its articles in order to protect more property owned by the missing.
