الاحتياط الفقهيُّ وتطبيقاتُه عند الشَّيخ أمحمد بن يوسف أطفيَّش من خلال ‏كتاب "شرح كتاب النِّيل"‏ ‏-باب العبادات والنِّكاح نموذجا– ‏

Résumé: يتناول الباحث في هذه الدِّراسة الفقهيَّة الأصوليَّة منهجاً من مناهجِ تقعيد الأحكام ‏واستنباطها ‏والنَّظر في مآلاتها، وهو ما يُصطلَح عليه شرعاً بـ: "الاحتياط"، أو: "الأخذ ‏بالأحوط". ‏ وقد جاءت الدِّراسة مقسَّمةً إلى قسمين، قسمٍ أوّلٍ وخُصِّص للجانب المعرفيِّ للدِّراسة؛ ‏حيث ‏تناول الباحثُ الاحتياطَ من النَّاحية النَّظريَّة التَّأصيليَّة؛ فعرَّف الاحتياطَ لغة ‏واصطلاحاً، ثمَّ بيَّن حجيَّة الاحتياط الفقهيِّ من الأدلَّة الأصليَّة؛ ثمَّ ذكر تقسيماته، وأورد ‏تعريف ‏وضوابطَ كلِّ نوعٍ. ‏ أمَّا القسم الثَّاني فخُصِّص للجانب التطبيقيِّ؛ حيث تناول الباحث مسألتين ‏فقهيَّتين: الأولى ‏في باب الطَّهارات، والثَّانية في باب الطلاق، وحصر الدراسة عند الشيخ أطفيش ‏من خلال ‏شرحه على النيل.‏ The researcher discusses this fundamental jurisprudence study as ‎precaution or to take ‎precaution.‎ The study was divided into two parts, the first one defined the ‎precaution. and thereafter ‎stated the jurisprudence precaution ‎argument from the genuine proofs, and he mentioned ‎subdivisions ‎of the precaution, and divided them into two consideration, and ‎mentioning ‎definition and regulations of each one.‎ But the other part of the study was designated for the applied ‎aspect discussed two ‎jurisprudence matters the first one in the ‎purities section and the other one in divorce section and ‎straiten the ‎study in Sheikh Atfeesh.‎ Key words: Precaution‏-‏‎ take the precaution‏-‏‎ Atfeesh- discharging ‎and Iddat of the ‎widow whose husband passed away.‎
