ضمانات ممارسة الحريات السياسية خلال الظروف الإستثنائية في الجزائر-قراءة في التعديل الدستوري لسنة 2020-

Résumé: تقر معظم التشريعات الدولية والداخلية مجموعة من الضمانات لممارسة الحقوق والحريات العامة، أهمها وجود دستور الدولة كقيد على سلطانها، تنعكس هذه الضمانات في مبدأ سمو الدستور والرقابة على دستورية القوانين في شقيها السياسي كما القضائي. تركز هذه الدراسة على مجموعة الضوابط القانونية التي يمكن بواسطتها توفير حماية للحقوق والحريات، بحيث يتقرر بطلان أي تصرف من السلطة مخالف لها، إلا أن الدولة قد تمر بظروف استثنائية تدفعها للخروج عن المشروعية العادية حماية للمصلحة العامة، مما قد يشكل تعد صارخ على الحقوق والحريات العامة وأهمها الحريات السياسية، كل ذلك يؤدي بنا إلى التساؤل هل من ضمانات تكفل لنا ممارسة حرياتنا السياسية في ظل هذه الظروف الاستثنائية؟ Most international and internal legislation recognizes a set of guarantees for the exercise of public rights and freedoms, the most important of which is the existence of the State Constitution as a restriction on its authority, reflected in the principle of the transcendence of the Constitution and the control of the constitutionality of laws in both political and judicial aspects. This study focuses on the set of legal controls by which rights and freedoms can be protected, so that any act of power contrary to it is decided, but the State may go through exceptional circumstances that would lead it out of normal legitimacy to protect the public interest, which could constitute a flagrant infringement on public rights and freedoms, the most important of which is political freedoms, all of which leads us to wonder whether there are guarantees that we will exercise our political freedoms under these exceptional circumstances?
