المسؤولية الاجتماعية للمستخدم في مجال التسريح الاقتصادي

Résumé: المسؤولية الاجتماعية هي استراتيجية تسيير ،غايتها تحقيق التوازن بين الأهداف الاقتصادية للمؤسسة والمطالب الاجتماعية للعمال ،وأهمها الحفاظ على مناصب الشغل ،مصدر المورد الاقتصادي الوحيد لهم ولأسرهم ،غير أنه قد تعترض المؤسسة صعوبات اقتصادية ومالية يضطر المستخدم على إثرها إلى تقليص عدد العمال حفاظا على استمرار نشاطه. نهدف من خلال مضمون الورقة البحثية إلى تسليط الضوء على تطبيقات المسؤولية الاجتماعية الواردة في مواصفة إيزو 26000 في قانون علاقات العمل وبالتحديد في مجال التسريح لسبب اقتصادي. وتوصلنا إلى أن مظاهر المسؤولية الاجتماعية تبرز حين يتفادى المستخدم اللجوء المباشر إلى تقليص عدد العمال والبحث عن حلول مالية أخرى ،بالإضافة إلى بناء التسريح على سبب اقتصادي حقيقي غير وهمي مع احترام تدابير المخطط الاجتماعي لاسيما التشاور مع لجنة المشاركة والتفاوض مع المنظمة النقابية التمثيلية. Abstract: Social responsibility is a management strategy, the goal of which is to achieve a balance between the economic goals of the institution and the social demands of workers, the most important of which is to maintain employment positions as the only economic resource for them and their families, but the institution may encounter economic and financial difficulties, after which the employer is forced to reduce the number of workers in order to maintain the continuation of his activity. We aim, through the content of the research paper, to shed light on the applications of social responsibility mentioned in ISO Standard 26000 in the Labor Relations Law, specifically in the field of layoffs for an economic reason. We concluded that the manifestations of social responsibility arise when the employer avoids direct recourse to reduce the number of workers and the search for other financial solutions, in addition to building layoffs on a real economic reason that is not fictitious, while respecting the measures of the social plan, especially consulting with the Participation Committee and negotiating with the representative union organization.
