التعويض التلقائي للحق في السلامة الجسدية

Résumé: نظرا للتطور الاقتصادي والتكنولوجي وكثرة المخاطر، فإنّ المسؤولية المدنية لم تعد كافية لتعويض ضحايا الأضرار، فاستحدثت أنظمة تعويض تلقائية لجبر أضرار الضحية دون عناء، وهذه الأنظمة خاصة بتعويض ضحايا الأضرار الجسمانية فقط ومبررات وجود هذه الأنظمة هو اجتماعية الأخطار واجتماعية التعويض فنظمت الدولة التضامن الاجتماعي (التأمين) كما تكفّلت الدولة بالتعويض بواسطة الصناديق الخاصة للتعويض، وتدخل الدولة هذا بجبر الأضرار الجسمانية أيّدته دستوريا وذلك بتبنيها مبدأً دستورياً يكرس الحق في السلامة الجسدية وذلك في المادة 39 في تعديل دستور 2020 وأُذكّر بخصائص التعويض التلقائي أنّه تعويض عام ومجرد، أي أنّ الضحايا متساوون فيه وأنه جزافي محدد مسبقا، وأنه يخضع لإجراءات إدارية فحسب.
