التشريع الإسلامي من التاريخ إلى النقد

Résumé: ملخص مقال: التشريع الإسلامي -من التاريخ إلى النقد- يقوم هذا البحث بتتبع الدراسات المتعلقة بتاريخ التشريع الإسلامي، فقد بدأت هذه الدراسات في العصر الحاضر إتباعا لاهتمام الغربيين بتاريخ العلوم ومنها تاريخ القانون، فكانت هذه الدراسات والبحوث محاولة من البعض لسد الفراغ حول تاريخ الفقه الإسلامي وتطوره. ونحن في هذا البحث سنركز على بعض النقاط المتعلقة بتاريخ الفقه والتشريع الإسلامي منها مفهوم تاريخ التشريع الإسلامي، وأسباب ودواعي دراسة هذا التاريخ والاهتمام به، وصولا إلى ذكر بعض المصادر والمراجع في تاريخ التشريع، وأخيرا سنتحدث عن نقد تاريخ التشريع الإسلامي، والمقصود بذلك نقد بعض المقولات حول هذا التاريخ في محاولة لتصحيحها، لأنها تعتبر في كثير من الأحيان مقولات اجتهادية تروم تفسير تاريخ التشريع الإسلامي إلا أنها جانبت الصواب، فهذه المقولات والآراء تزيد الجو الفكري غموضا وتضع الباحث في طريق خاطئ يؤدي به إلى سوء فهم وتقدير لحركية الفقه الإسلامي وطريقة تطوره وانتشاره في العالم الإسلامي. Abstract : Islamic legislation- from history to criticism- This research traces the studies related to the history of Islamic legislation. These studies began in the present era, following the interest of Westerners in the history of sciences, including the law history. These studies and research were an attempt by some to fill the void around the history and development of Islamic jurisprudence. In this research, we will focus on some points related to the history of jurisprudence and Islamic legislation, including the concept of the history of Islamic legislation, and the reasons for studying this history and paying attention to it, leading to mention of some sources and references in the history of legislation, and finally we will talk about criticism of the history of Islamic legislation, and this is intended to criticize some of the sayings about this history to correct them, because it is often considered as jurisprudential statements that seek to explain the Islamic legislation history, but it veered from the truth. These sayings and opinions increase the intellectual ambiguity and put the researcher on a wrong way that leads him to a misunderstanding and appreciation of the movement of Islamic jurisprudence and the method of its development and spread in the Islamic world.
