الحماية الجزائية للتوقيع الإلكتروني في التشريع الجزائري

Résumé: تبقى الحماية الموضوعية والإجرائية مهما بلغت درجتها عاجزة عن مسايرة التطور الرهيب الذي تشهده الجرائم الواقعة على التوقيع الإلكتروني،وهو ما أدى إلى استفحال الجريمة الإلكترونية وتسبب في أضرار مادية ومالية وحتى نفسية للعديد من الضحايا. حيث تبين من هذه الدراسة مدى خطورة الجرائم الماسة بالتوقيع الإلكتروني، وهذا راجع إلى خصوصيتها حاصة من الجانب التقني،وصعوبة الاكتشاف والإثبات،حيث وقفت مختلف النظم القانونية عاجزة عن مواكبة تطور هذه الجرائم ومكافحتها،وأمام هذه الوضعية حاول المشرع الجزائري الحد من خطورة هذه الجرائم ،من خلال إدراجه لتعديلات هامة على قانون العقوبات وقانون الإجراءات الجزائية،وسن قوانين ومراسيم تتعلق بالتوقيع الإلكتروني من خلال قانون التوقيع والتصديق الإلكتروني. Summary Objective and procedural protection,regardless of its degree, remains unable to pace with the tirrible development witnessed by the crimes committed against the electronice signature, which led to the exacerbation of electronic crime and caused material, financial and even psychological damage to many victims. This study showed the extent of the seriousness of the crimes related to the electronic signateur,and this is due to its specificity,especially from the technical side,and difficulte to discover and prove,as the various legal systems were unable to keep pace with the development of this crimes and combat them,and in the face of this situation,the algerian legislator tried to reduce the seriousness of these crimes,by including important amendments to the penal code and the code of criminal procedure,and the enactment of laws and decrees related to electronic signature through the electronic signature and certification law.
