تأثير الأنظمة القانونية للمنشآت المصنفة على حماية البيئة في الجزائر

Résumé: ملخص: مكنت التكنولوجيا المتطورة في شتى المجالات الانسان من تطويع الطبيعة واستغلال كافة مواردها، وذلك عن طريق استحداث أنماط من الأنشطة الزراعية والصناعية والتجارية؛ بما يلبي حاجاته اللامتناهية سعيا نحو حياة أفضل، غير أنه بالمقابل تسبب الإفراط في هذه الأنشطة إلى اختلال التوازن الطبيعي لعناصر البيئة، بما يهدد حياة الإنسان والحيوان والنبات على حد سواء، وتطبيقا لالتزامات الجزائر الدولية في مجال حماية البيئة حيث سارع المشرع إلى استحداث إطار قانوني خاص لتنظيم هذا النوع من الأنشطة في شكل ما يسمى "بالمنشآت المصنفة" لحماية البيئة. حيث يهدف هذا البحث إلى توضيح الإطار القانوني الخاص بالمنشآت المصنفة، وذلك بتعريفها وتصنيفها وتوضيح إجراءات وشروط استغلالها، إضافة إلى ذلك فرض آليات الرقابة السابقة واللاحقة عليها، وكذا توقيع العقوبات الإدارية والجزائية، وأخيرا إلى مدى تأثير أنشطتها على البيئة باعتبارها من المصادر الهامة للتلوث البيئي بكافة أشكاله. وعليه تعتبر شروط استغلال المنشآت المصنفة وتدابير الرقابة عليها وتشديد الجزاءات المتعلقة بمخالفة أحكامها من بين الآليات الهامة لتوفير حماية فعالة للحد من الأضرار والأخطار التي تسببها مختلف أنشطتها على عناصر البيئة. كلمات مفتاحية: المنشأة المصنفة، دراسة أو موجز التأثير، دراسة الخطر، الترخيص، التصريح. Abstract: The advanced technology has enabled people in various areas to adapt nature and exploit all its resources by developing patterns of agricultural, industrial and commercial activities; to meet their endless needs towards a better life, however the excessive of these activities have caused a natural imbalance of the elements of environment, which threatens the life of man, animals and plants alike , pursuanting to Algeria’s international commitments in environmental protection whereby the legistlator has hastened to develop a special legal framework to regulate this type of activity in a form which called " The Facilities Classified " for environmental protection. This research is aimed to clarify the private law frame of the facilities classified, clarifying the procedures and conditions of their exploitation, imposing the previous and subsequent control mechanisms, and binding administrative and penal sanctions, in purpose to reduce the negative effects of such facilitie for the environment as an important source of environmental pollution in all its forms. Accordingly, the conditions for exploitation and control of the facilities classified and tightening of sanctions against violations of their provisions and important mechanisms to provide effective protection to reduce damage and risks that caused by their various activities on environment elements.
