Résumé: التأصيل القانوني لانتقال حق المتصرف اليه الى الجزء الذي آل إلى المتصرف بطريقة القسمة Legal rooting for the transfer of the right of the district administrator to him part of the way to the district administrator division د.أسماء محمد الرقاد* جامعة البلقاء التطبيقية ، الاردن. تاريخ الارسال تاريخ القبول 15/11/2015 تاريخ النشر ملخص غدا من أدبيات البحث العلمي السعي نحو التأصيل القانوني للفكرة التي تضمنتها قضية ما وذلك عن طريق العمل لوضعها في محيطها الخاص واستقراء موقف التشريع منها ، هذا التوجه أثر على هذه الدراسة حينما ظهرت المشكلة حول تأصيل انتقال حق المتصرف إليه إلى الجزء الذي آل إلى المتصرف بنتيجة القسمة . حيث جاءت هذه الدراسة فاحصة ومحللة لنصوص القانون المدني الأردني التي منحت الشريك المشتاع حق التصرف بحصته في المال الشائع، إضافة إلى تحليل بعض القواعد والأسس التي يمكن أن يستند إليها انتقال حق المتصرف إليه إلى الجزء الجديد بطريقة القسمة كالحلول العيني حيث توصلت الدراسة إلى إمكانية إعمال قواعد الحلول العيني مع ضرورة قيام شروطه، إضافة إلى بيان أثر القسمة في بيان حصة المتصرف ,إمكانية تأسيس حق الانتقال بناء عليها . Abstract From the literature of scientific research pursuit of legal rooting idea contained in a case and by working to put it in your surroundings and to extrapolate the legislation, including the position, this trend impact on this study, when the problem about rooting transmission right disposed him to the part that has fallen into the administrator of the outcome of the division emerged. Where it came from such a close study and an analyst with the provisions of the Jordanian civil law which granted the joint partner the right to dispose of its share in the common money, in addition to the analysis of some of the rules and principles that can be based on the transmission of the right disposed him to the new part way division such as ophthalmic solutions, where the study found the possibility of realization rules-kind solutions with the need for the conditions, in addition to the impact statement division in a statement disposed share, the possibility of establishing the right to move on them.
