حماية الممتلكات الثقافية أثناء النزاع المسلح بين الشريعة الإسلامية والقانون الدولي الإنساني
Résumé: "يعتبر موضوع حماية الممتلكات الثقافية أثناء النزاع المسلّح من المواضيع ذات الأهمية الكبيرة في عصرنا الحاضر، كان محور دراسة هذا موضوع في الشريعة الإسلامية والقانون الدولي الإنساني، إذ تدور إشكالية حول إلى أي مدى كفلت الشريعة الإسلامية والقانون الدولي الإنساني حماية الممتلكات الثقافية أثناء النزاع المسلّح ؟ قسمت الدراسة إلى أربعة مباحث: قدم المبحث التمهيدي لبيان ما مفهوم الحماية الممتلكات الثقافية أثناء النزاع المسلّح، يليه المبحث الأول أحكام الحماية الممتلكات الثقافية أثناء النزاع المسلّح في الشريعة الإسلامية، وثالثه أحكام الحماية الممتلكات الثقافية أثناء النزاع المسلّح، والأخير في المسؤولية المترتبة عن انتهاك أحكام الحماية الممتلكات الثقافية أثناء النزاع المسلّح. من أهم النتائج التي توصلت إليها في الدراسة الموضوع أن كل من الشريعة الإسلامية والقانون الدولي الإنساني يتفقان على حماية الممتلكات الثقافية أثناء النزاع المسلّح، باعتبارها التراث الإنساني المشترك.
