ضبط نشاط الإعلام عبر الأنترنت في القانون الجزائري Regulation Of Electronic Media Activity In Algerian Law

Résumé: اعترف المشرّع الجزائري بموجب القانون العضوي رقم 12-05 المؤرّخ في 12 يناير سنة 2012 والمتعلّق بالإعلام، بحريّة الإعلام عبر الأنترنت، وحصر ممارستها في الصّحافة الالكترونيّة وخدمة السمعي البصري عبر الانترنت، وكلّف سلطة ضبط الصّحافة المكتوبة وسلطة ضبط السّمعي البصري بضبط نشاط الاعلام عبر الأنترنت كلّا في حدود الاختصاصات المخولة لها قانونا، وبموجب المرسوم التنفيذي رقم 20-332 المؤرّخ في 22 نوفمبر سنة 2020 المحدد لكيفيات ممارسة الاعلام عبر الأنترنت ونشر الرّد أو التّصحيح عبر الموقع الالكتروني، تمّ منح هاتين السّلطتين مجموعة من الصّلاحيّات الرّقابيّة والعقابيّة للقيام بمهمتها في الضبط. وسنحاول في هذا البحث تبيان طبيعة كلّ سلطة والمهام المخوّلة لها في إطار عمليّة ضبط الإعلام عبر الأنترنت عن طريق تحليل النّصوص المنظّمة لها، للتوصل في الأخير إلى مدى تماشيها والطّبيعة الالكترونيّة لنشاط الإعلام عبر الأنترنت. Under the organic law N° 12-05 that dates back to January 12th, 2012 relating to the information, the Algerian Legislator recognized the freedom of information via the Internet and confined its activities to electronic journalism and the audio-visual service through the Internet, and assigned the print press regulatory authority and the audio-visual regulatory authority to regulate the activity of the media via the Internet; each in its respective competence legally conferred upon it; and in accordance with executive decree N° 20-332 of November 22nd ,2020, that specified the modalities for practicing information through the Internet and publishing the reply or a corrective feedback via the website. The two authorities were granted a set of oversight and punitive powers in order to execute their function of regulating. In this study, we aim to identify the nature of each authority and the powers conferred upon it in terms of regulating information via the Internet by analyzing the texts that organizes them, in order to finally arrive to the extent of their compliance with the electronic nature of information activity via the Internet.
