الطابع الخاص لتجريم الجريمة المنظمة في التشريع الجزائري

Résumé: الملخص: أجرى المشرع الجزائري تكييفا على قوانينه الداخلية بما يتماشى و مقتضيات خصوصية الجريمة المنظمة إذ انتهج سياسة تجريمية شملت تعديلات خاصة في القواعد الإجرائية والموضوعية واستحداث قوانين خاصة، قصد تطويق نشاطات المنظمات الإجرامية التي أصبحت تشكل خطرا كبيرا على المجتمع، وكانت البداية بتمديد الاختصاص المحلي لكل من ضباط الشرطة القضائية ووكلاء الجمهورية وقضاة التحقيق، ليخطوا خطوة سابقة من نوعها في التخصص للمعالجة القضائية لطائفة من الجرائم باستحداث أقطاب قضائية متخصصة ، حيث تستقطب وتستأثر بالاختصاص في القضايا ذات الصلة بالجرائم الخطيرة كما كفل المشرع للجهات القضائية اختصاصات تساعد على إظهار الحقيقة وإثارة الدليل فيما يخص الجريمة المنظمة. Abstract : The Algerian legislator has adapted its internal laws in line with the requirements of the specificity of organized crime, as he pursued a criminal policy that included special amendments to procedural and substantive rules and the development of special laws, in order to circumvent the activities of criminal organizations that have become a major threat to society, and the beginning was to extend the local jurisdiction of each of the officers Judicial police, agents of the republic and investigative judges, to take a previous step of its kind in the specialization of the judicial treatment of a range of crimes by creating specialized judicial poles, where it attracts and monopolizes competence in cases related to serious crimes and has also ensured the A project for judicial authorities with terms of reference to help reveal the truth and raise evidence regarding organized crime.
