مشروعية القتل الرحيم بين الاباحة والتجريم

Résumé: يعتبر الحق في الحياة من الحقوق المقدسة في الشرائع السماوية، والحقوق الاساسية التي تحميها التشريعات الوضعية، الا ان الانسان قد يتعرض لنوبات صحية مستعصية تصل الى حد الياس من شفائها، مما يدفعه الى المطالبة بوضع حد لحياته، وهو ما اصبح يعرف بالموت الرحيم، وقد يقرر الطبيب من تلقاء نفسه او بناء على طلب من المريض او ذويه انهاء حياة المريض الميؤوس من شفائه اشفاقاً عليه لتخليصه من الالام. واصبح القتل الرحيم يثير الجدل بخصوص مشروعيته في الاوساط الطبية والقانونية والدينية بين مؤيد ومعارض، وتهدف هذه الدراسة الى ابراز موقف الفقه والشرائع السماوية والوضعية من القتل الرحيم، خاصة وان اجازة هذا النوع من القتل تؤدي الى تحول اخطر الجرائم على الاطلاق الى حق انساني مشروع، وقد يتم توسيع مجاله مستقبلا من الامراض المستعصية والميؤوس منها، ليشمل حالات اخرى كالمعاقين حركيا وذهنيا والمشوهين جسدياً.
