ضوابط ترقية الموظف العام في التشريع الجزائري

Résumé: لقد تطرقنا في هذه المذكرة الى دراسة ضوابط ترقية الموظف العام في التشريع الجزائري ، فقد درسنا في الفصل الاول النظام القانوني لترقية ، وهو موضوع بالغ الاهمية بالنسبة لفئة الموظفين العمومين ، اذا تعتبر غاية يطمح اليها الموظفين لانها تفسح لهم المجال للوصول الى المناصب العالية ، حيث نجد المشرع الجزائري نظم الترقية من خلال الامر 06/03 متضمن القانون الاساسي العام وفق شروط و إجراءات معينة ، اما في الفصل الثاني فتطرقنا الى دراسة معايير ترقية الموظف العام لتشريع الجزائري ، فيجب اولا الوقوف على المعايير التي يجب توافرها في الموظف العمومية وإلزام الادارة التقييد بها ، وفي حالة الاخلال بها يجب وضع جزاءات تأديبية على من لا يحترمها كذالك بالرغم من توافر شروط الترقية الا انه توجد بعض الاسباب تحول دون ترقيته وهي ما تعرف بموانع الترقية .In this note, we have discussed the study of the regulations for promoting a public servant in Algerian legislation. In the first chapter, we studied the legal system for promotion, which is a very important topic for the category of public servants, if it is considered a goal that employees aspire to because it allows them to reach high positions, where we find The Algerian legislator organized the promotion through Ordinance 06/03, including the general basic law, according to certain conditions and procedures. In the second chapter, we discussed the criteria for promoting the public employee to the Algerian legislation. It is necessary first to identify the standards that must be met by the public employee and to oblige the administration to adhere to them. In the event of a breach of it, disciplinary sanctions must be imposed on those who do not respect them as well, despite the availability of promotion conditions, but there are some reasons preventing his promotion, which are what are known as the obstacles to promotion.
