حق الرد والتصحيح في جرائم النشر الصحفي في ظل قانون الاعلام الجزائري 12/05

Résumé: ملخص: اختلفت مجالات ممارسة حرية التعبير باختلاف وسائل الإعلام والاتصال ، وأضاف إليها التطور التكنولوجي نطاقا أوسع ومجالا أرحب من حيث الكم والكيف ، فأصبحت غاية الصحفي الأساسية هي الحصول على المعلومة ونشرها أي كانت نتائجها ، مما قد يؤدي إلى إلحاق أضرار بالغير سواء كانت مادية أو معنوية ، أو تمس مراكزهم المالية أو مكانتهم الاجتماعية أو شرفهم واعتبارهم ، و يزداد هذا الإضرار جسامة مع زيادة تأثير الصحف في الرأي العام الأمر الذي فرض على المشرع التكيف معه من خلال وضع ضوابط قانونية متمثلة في حق الرد والتصحيح ومنحه حقا للمتضرر ، فتم إعادة النظر في قانون الإعلام 90/07 بإضافة مواد وحذف أخرى تماشيا مع المستجدات الطارئة من جهة ومحاولة التوفيق بين فعل التجريم الناتج عن النشر و فعل الرد والتصحيح المترتب عن هذا الأخير من جهة أخرى . فهدف هذه الدراسة هو توضيح الإطار القانوني لكل من حق الرد والتصحيح وكذا توضيح الأثار المترتبة على ممارستهما Abstract: The technological development has had a great impact on the exercise of freedom of expression in various media and communication , which made the journalist’s basic goal is to obtain information and disseminate it without taking into account the physical and moral damage to others , which affect their financial position and social status and considerations. Since the newspapers are the main influence on public opinion, the Algerian legislator resorted to the establishment of legal controls in the right of reply and correction of the affected by reviewing the information law 07/90 by adding other materials and delete in line with the emergency developments and try to reconcile the act of criminalization and the rights of reply and correction.
