دور قانون التأمين في كفالة حق الدائن

Résumé: تعتبر أموال المدين جميعها ضامنة الوفاء بديونه وهو ما يشكل الضمان العام، وقد يخصص المدين ضمانًا خاصًا لصالح الدائن متمثل في تأمينات عينية رهناً أو تخصيصاً، إلا أن هذه الضمانات سواء العامة أو الخاصة قد تتعرض لعدة مخاطر منها للهلاك أو التلف، الأمر الذي ينقص من قيمة هذا الضمان مما لا يحقق الأمان الكافي للمدين لاستيفاء ديونه. وتعالج هذه الدراسة وسائل حماية الضمان العام والخاص بواسطة قانون التأمينات و دوره في كفالة حق الدائن من خلال تعزيز حماية هذا الضمان الى جانب الوسائل التقليدية المعروفة في القواعد العامة وذلك من خلال تسليط الضوء على الأطر القانونية لذلك. The debts of the debtor are pledged against all his property, which constitutes the general guarantee. And the debtor can allocate a special guarantee for the benefit of the creditor, represented by mortgage or assignment titles. However, these guarantees, whether general or special, can be exposed to several risks, including loss or damage; this reduces the value of this collateral, which is not sufficient collateral for the debtor. This study deals with the means of protecting general and special guarantees through insurance law and its role in guaranteeing the creditor's right by strengthening the protection of this , in addition to the means dealt with in the general rules.
