القيود الواردة على حرية الصحافة في قوانين الإعلام الجزائرية(1982-1990-2012)

Résumé: تعد حرية الصحافة امتدادا لحرية الفكـر والاعتقاد حينما تبرز للعالم الخارجـي وتتجاوز الفكــرة التي يؤمن بها إنسان ما إلى إشراك الآخرين، فحرية الفكر تكمن داخل الإنسان، وممارستها تعني حرية الرأي، وحرية الصحافة هي إحدى تطبيقاتها وهذا ما يجعلها مــن أخطـر وأهــم القضايا المطروحة، الأمـــــــر الذي أدى بالسلطات ذاتها إلى فرض عدة قيود على إصدار الصحف سواء قبل أو بعد النشر، وهـــذا الصراع القائم بين السلطة والصحافة ظل وما زال قائما بدرجات متفاوتة. فالحرية الصحفية والحــق في الرأي والتعبيـر من أكبر المكاسب التي تحققت للصحافـة في كل بلد والتي جعلت منها سلطــــة رابعة قولا وفعلا، برغم كل القيـود والعوائق والحدود التي ترد عليها في القوانين والتي تعد ضرورية في بعض الأحيان وغير ذلك في أحيان أخرى. Abstract: Freedom of the journalism is an extension of the freedom of thought and belief when it stands out to the outside world and goes beyond the idea that a person believes in the involvement of others. Freedom of thought lies within the human being, and its exercise means freedom of opinion. Freedom of the journalism is one of its applications and this makes it one of the most serious and important issues. The same to impose several restrictions on the issuance of newspapers both before and after publication, and this conflict between the authorities and the journalism has existed for several years, the freedom of journalism and the right of opinion and expression considered as the biggest gains made to the journalism in each country which has made them a fourth authority in word and deed, despite all restrictions and barriers and borders that are set forth in the laws.
