اتفاقيات الاتحاد الأوروبي لإعادة القبول كآلية لمواجهة ظاهرة الهجرة غير النظامية

Résumé: تهدف هذه الدراسة لتسليط الضوء على اتفاقيات الاتحاد الأوروبي لإعادة القبول، والتي تستعملها الدول الأوروبية كآلية للتصدي لظاهرة الهجرة غير النظامية والتي تشهد معدلاتها تزايد مطرد نحو الوجهة الأوروبية. بحيث توجه هذه الاتفاقيات لإعادة الرعايا المهاجرين بصفة غير نظامية إلى دول الاتحاد الأوروبي إلى دولهم الأصلية. وعلى هذا الأساس سمحت لنا هذه الدراسة بتبيان أنماط وإجراءات ابرام اتفاقيات إعادة القبول التي يبرمها الاتحاد الأوروبي مع دول المصدر، والتي من بينها الجزائر باعتبارها دولة معنية بظاهرة الهجرة غير النظامية سيما اتجاه الأقاليم الأوروبية. كما سمحت لنا الدراسة باستنتاج طبيعة وخصوصية هذه الاتفاقيات من جهة، ومدى نجاعتها في الحد من ظاهرة الهجرة غير النظامية، وذلك في كونها تحمل طابعا قسريا في معالجة ظاهرة الهجرة غير النظامية يقتضي ترحيل المهاجرين بطرق جبرية فضلا عن كونها تحمل انعكاسات خطيرة على حقوق المهاجرين، من جهة، ومن جهة أخرى تبين لنا عجز هذه الاتفاقيات في الحد من ظاهرة الهجرة غير النظامية وفشلها في الحد من تداعياتها وذلك بحكم ارتفاع معدلاتها بوتيرة متصاعدة إلى يومنا هذا وهو ما يتطلب التفكير في بدائل أخرى لمعالجة هذه الظاهرة الإنسانية التي يعرفها المجتمع الدولي حاليا. . Abstract: These European countries use conventions as a mechanism to address the phenomenon of irregular migration, whose rates are increasing towards the European destination. So that these conventions refer to the repatriation of irregular migrants to EU countries to their countries of origin. This study has allowed us to describe the patterns and procedures for the conclusion of the EU's re-acceptance agreements with the countries of origin, including Algeria as a country concerned with the phenomenon of irregular migration, especially towards the European regions. The study also allowed us to conclude the nature and specificity of these agreements and their effectiveness in reducing the phenomenon of irregular migration in that they have a coercive nature that requires the forced deportation of migrants. On the other hand, the inability of these agreements to reduce the phenomenon of irregular migration and its failure to limit Because of their high rates at a growing pace to this day, which requires thinking of other alternatives to address this humanitarian phenomenon, which is known by the international community now. .
