الفريق الطبي في القانون الجزائري والقانون التونسي

Résumé: سمح تطور الطب عبر العصور بظهور الفريق الطبي، من خلال تظافر جهود ممتهني الصحة وتعاونهم كل في تخصصه بهدف تحسين الحالة الصحية للمريض، فلا يتصور إجراء عملية جراحية من طرف طبيب واحد؛ تتسم الالتزامات في الفريق الطبي أنها متداخلة لتعدد أعضائه ولتباين علاقته بالمستشفى إن كانت تنظيمية أو عقدية، فيتحمل المستشفى العمومي تنفيذ الالتزام في القانون الجزائري ويمكنه بعد ذلك وفق القانون التونسي من استرجاع ما وفاه من المخل بالالتزام، أمّا المستشفى الخاص فيتعامل مع رئيس الفريق الطبي الذي يتحمل تنفيذ الالتزام في العقد الطبي الوحيد وفي حالة تعدد العقود، وبهذا سهلت فكرة الفريق الطبي حصول المريض المضرور على حقه. Abstract: The development of medicine through the ages has allowed the emergence of the medical team, through the concerted efforts of health professionals and their cooperation in their respective specialties with the aim of improving the patient's health condition, as it is not conceivable that surgery will be performed by a single doctor; the obligations in the medical team are intertwined because of its multi-member membership and the difference in its relationship with the hospital, whether organizational or contractual, the public hospital carries out the responsibility of implementing the obligation in Algerian law and has the right to refer to the violator of the obligation to in Tunisian law , while the private hospital deals with the head of the medical team who assumes the obligation in the case of the single medical contract and in the case of multiple contracts, and thus the idea of the medical team facilitates the access of the injured patient to his right.
