مكافحة الجرائم البيئية في التشريع الجزائري والقوانين المقارنة

Résumé: الملخص: بالرغم من الأهمية البالغة التي تكتسيها الآليات الوقائية في ضمان توفير حماية وقائية للبيئة، إلا أنها لا يمكن أن تضمن في كل الحالات عدم وقوع أضرار تصيب البيئة سواء بفشل قواعد الإحتياط أو بسبب الانتهاكات المستمرة للبيئة من طرف الإنسان، الأمر الذي أوجب على الدول ومنها الجزائر إلى إصدار تشريعات وقوانين لحماية البيئة ومعاقبة مرتكبي الجرائم البيئية، مع تدعيمها بجزاءات جنائية تتنوع حسب درجة خطورة الجريمة المرتكبة فقد تكون العقوبة أصلية أو قد تكون تكميلية، تطبق على الأشخاص الطبيعيين والمعنويين في حالة مخالفة القواعد القانونية المنصوص عنها في مختلف القوانين المتعلقة بحماية البيئة. Abstract: Despite the extreme importance of the preventive mechanisms in ensuring the provision of preventive protection for the environment, it cannot guarantee in all cases that there will be no damage to the environment, whether due to the failure of the reserves rules or because of the continuous violations of the environment by man, which obligated the countries, including Algeria, to Issuing legislation and laws to protect the environment and punish the perpetrators of environmental crimes, while supporting them with criminal penalties that vary according to the degree of severity of the crime committed, the punishment may be original or may be complementary, applied to natural and legal persons in case of violating the legal rules stipulated in various Laws related to environmental protection.
