خصوصية منازعات الجباية العقارية في القانون الجزائري

Résumé: تستمد المنازعة الجبائية العقارية خصوصيتها من طبيعة القانون الجبائي و ما تحمله نصوصه من ذاتية ينفرد بها عن باقي القوانين، لذا نهدف من خلال هذه الدراسة إلى إبراز مكانة المنازعة الجبائية العقارية في التشريع الجزائري و كذا إبراز معالم الخصوصية التي تميز هذه المنازعة عن سائر المنازعات الإدارية، و ذلك من خلال التعرض إلى جميع الأحكام الإجرائية و الموضوعية المتعلقة بها و التي بينت لنا أن منازعات الجباية العقارية تتميز بخاصية إجرائية أساسية تتمثل في أن طريقة حل النزاع فيها تمر عبر مرحلتين أساسيتين؛ الأولى إدارية و الثانية قضائية، كما أنها تخضع للأحكام الخاصة المنظمة بموجب قانون الإجراءات الجبائية إلى جانب أحكام قانون الإجراءات المدنية و الإدارية. The real estate tax dispute derives its specificity from the nature of the tax law and what its texts carry of an entity that is unique to other laws. Therefore, through this study, we aim to highlight the status if the real estate tax dispute in Algerian legislation and so focus attention on the features of the specificity that distinguishes this dispute from other administrative disputes, And that is through exposure to all the procedural and substantive provisions related to it, which showed us that real estate tax dispute are characterized by a basic procedural feature represented in the method of resolving the dispute that passes through tow basic stages: The first is administrative and the second is judicial. It is also subject to the particular provisions regulated by the code of tax procedure in addition to the provisions of the civil and Administrative procedures law.
