Résumé: "تناولتُ في هذا البحث الاختيارات الفقهية لابن رشد الحفيد في كتابه بداية المجتهد ونهاية المقتصد ( السرقة والحرابة أنموذجا)، فقمتُ بدراسة المسائل التي اختارها ابن رشد الحفيد في كتابَيْ السرقة والحرابة دراسة فقهية مقارنة، وهذا من خلال ذكر أقوال الفقهاء فيها، وأدلتهم، ومناقشتها، وكذا الرأي الذي اختاره المُؤَلِّف، حيث جاء هذا الموضوع في ثلاثة مباحث، خُصّص المبحث الأول لدراسة حياة ابن رشد الحفيد الشخصية والعلمية، إلى جانب مُؤَلَّفه، وكذا مفهوم الاختيارات، بينما خُصِّص المبحث الثاني لدراسة المسائل التي اختارها ابن رشد الحفيد المتعلقة بالسرقة، أما المبحث الثالث تناولتُ فيه المسائل المتعلقة بالحِرابة. وقد خَلُص البحث إلى جملة من النتائج والتوصيات قد أشرت إليها في الخاتمة. " The papers beforehand studies the approach of Ibn Roshd in his book. I have comparatively observed how Ibn-Roshd chose specific cases to justify his fatwa. That I did by comparing his approach to other scholars. The research, in three chapters, deals with the topic above mentioned. Chapter one: provides sufficient account of Ibn-Rosh's life, his character and educational career, his books, and what approach means. Chapter two investigates the cases chosen by the scholar, theft and defiance. The last chapter deals with defiance. The study concludes with recommendations that are based on research findings.
