المسؤولية العقدية عن الإخلال بالالتزام بمطابقة المنتجات الغذائية في التشريع الجزائري Contractual Liability For Irregularity In Conformity With Food Products In Algerian Legislation

Résumé: الملخص: أدى التقدم التكنولوجي الذي مس مختلف المنتجات لاسيما المنتجات الغذائية، إلى تهافت المستهلكين لاقتنائها، إلا أن هذا التقدم في تطور المنتجات لم يخل من مختلف الأضرار التي قد تصيب المستهلكين، وذلك لعدم احترام المتدخلين للمواصفات المتفق عليها أو التي يستلزمها القانون، مما دفع المشرع الجزائري إلى حماية الطرف الضعيف في العلاقة التعاقدية وهو المستهلك وذلك بفرض الالتزام بالمطابقة على المتدخل مع ترتيب مسؤوليته العقدية في حالة الإخلال بهذا الإلتزام، من خلال ما نص عليه في القانون المدني وقانون حماية المستهلك وقمع الغش. Abstract: Technological advance that has touched different products that have led to the rush of consumers to purchase them. However, this progress in the development of products has not been without various damages that may affect consumers .This is due to the non-respect of interveners to the descriptions that they have agreed on them , or required by the law which pushed Algerian legislator to protect the weak party in contractual relationships that is “ the consumer” by imposing a compliance obligation on interveners with the arrangement of its contractual liability in case of violation of this obligation through what ids stated in the civil code, the consumer protection and the suppression of fraud.
