عمل المرأة المتزوجة في الفقه الإسلامي والتشريعات الوضعية

Résumé: في بحثنا هذا نسلط الضوء على الضوابط الشرعية لعمل المرأة، والآليات التي تعْطِيْهَا وتُغَطّيْهَا التشريعات الوضعية الأساسية تحديدا، بداية بالدستور باعتباره الإطار الأمثل لتعزيز روابط العلاقات الوطنية الأسرية منها والمهنية، والوقوف على التباين الذي يصنعه قانون العمل 09-11 والقانون العام الأساسي للوظيفة العامة 06-03 في بسط الحماية والتسهيلات في نصوصهم وقطاعاتهم للمرأة العاملة المتزوجة ومدى مراعاتهم لخصوصياتها الطبيعية والفيزيولوجية وازدواجية أدوارها، ومقدار الثقة والأمان الذي تحظى بهما في ممارساتها الوظيفية اليومية . In this research, we shed light on the legal controls on women’s work, and the mechanisms that give and specifically cover them with basic positive legislation, beginning with the constitution as the ideal framework for strengthening the ties of national relations, including family and professional, and to identify the differences made by Labor Law 11-09 and the Basic General Law for Public Service 06- 03 In extending protection and facilitation in their texts and sectors to married working women and the extent to which they take into account their natural and physiological peculiarities and the duality of their roles, and the amount of confidence and security they enjoy in their daily functional practices.
