Résumé: الملخص: نتج عن تطبيق عقوبة الحبس قصيرة المدة أزمة تجلت مظاهرها في عدة مساوئ،إنعكست على المحكوم عليه وإقتصاد الدولة . فشلت هذه العقوبة على تحقيق أغراض العقوبة التي تنشدها السياسة العقابية المعاصرة، مما دفع بالباحثين في القانون الجنائي إلى البحث عن بدائل أكثر فاعلية و نجاعة، تراعي أنسنة العقاب وتتصدى لتلك الأزمة، فتوصلوا إلى عدة بدائل تتماشى مع شخصية الجاني وخطورته الإThe application of a short-term prison sentence resulted in a crisis whose manifestations were manifested in several disadvantages, which were reflected in the sentenced person and the state's economy.
