الترجيح بعمل أهل المدينة عند المالكية-دراسة نظرية تطبيقية
Résumé: ملخص: تناولت في هذا البحث مسلكا من مسالك الترجيح الخارجية بين الأخبار المتعارضة عند المالكية، ويتمثل في موافقة عمل أهل المدينة لأحد الخبرين، والغرض من ذلك بيان أنّ ما اشتهر به الإمام مالك من تقديمه العمل على أخبار الآحاد له جملة من التفسيرات، ومنها أنّ هذا العمل في حقيقة الأمر مستند إلى أخبار أخرى تعارضها، وقد تمّ في هذا البحث توضيح معنى هذا المسلك وبيان آراء العلماء وأدلتهم، مع ذكر نماذج تطبيقية تدلّ على هذا النوع من الترجيح. Abstract : In this research, I dealt with one of the methods of external weighting between the hadiths to the Malikis, which is that the work of the people of Medina agrees with one of the two hadiths, and The purpose of this is to clarify This is what Imam Malik was famous for, who preferred this work to hadiths narrated by one, has a number of interpretat., including that this work is in fact It is based on other hadiths that contradict it. In this research, I explained the meaning of this method, the opinions of scholars and their motives, and I indicated practical examples that indicate this type of weighting.
