دراسة تأصيلية للنظام العقابي للمسؤولية الجزائية للشخص الإعتباري في ضوء تعديل قانون العقوبات وقانون الإجراءات الجزائية لدى المشرع الجزائري

Résumé: يهدف البحث لتسليط الضوء على مسألة غاية في الأهمية بعد تنامي النشاط الإجرامي للأشخاص الإعتبارية والذي فاق النشاط الإجرامي للشخص الطبيعي ،خاصة في الآونة الأخيرة ،والإشكالية التي نعالجها ما هو النظام العقابي المسلط من طرف المشرع على الشخص الاعتباري سواء في العقوبات أو من ناحية الإجراءات الخاصة بالمحاكمة والمتابعة،من خلال التعديل الذي أدرجه على قانون العقوبات وقانون الإجراءات الجزائية ،وذلك من خلال المنهج التحليلي الوصفي لتحليل كافة الأفكار وتفصيلها،ولقد توصلنا، أن المشرع الجزائري و إن استحدث المسؤولية الجزائية إلا انه لم يحدث انسجام من حيث العقوبات بين النصوص التي تحكم الجرائم المتابع بها فيما بينها و بين القاعدة العامة الواردة في المادة 18 مكرر رغم تنوع العقوبات المستحدثة. The research aims to shed light on a very important issue after the growth of the criminal activity of legal persons, which exceeded the criminal activity of the natural person, especially in recent times, and the problem that we are dealing with is what is the punitive system imposed by the legislator on the legal person, whether in penalties or in terms of procedures for the trial And follow-up, through the amendment that he included in the Penal Code and the Code of Criminal Procedure, through the descriptive analytical approach to analyze and detail all the ideas, and we have found that the Algerian legislator, even if he introduced criminal responsibility, but that there was no harmony in terms of penalties between the texts governing the following crimes. between them and the general rule contained in Article 18 bis, despite the variety of penalties introduced.
