مشروعية الإعلان التجاري كآلية لحماية المحل التجاري والمستهلك

Résumé: إن الإعلانات التجارية تعد إحدى وسائل المنافسة في عصرنا الحديث وهي الأكثر انتشارا ومعرفة بواسطة المستهلك والأكثر استخداما بواسطة الشركات عند الترويج لمنتجاتها فالإعلانات التجارية وسيلة غير شخصية تتولى تقديم السلع والخدمات إلى الأسواق وهذا من أجل تحقيق أهداف ربحية وطموحات المستهلك بأكبر كفاية ممكنة. ولكن الحقيقة التي لا يمكن إنكارها بأن الإعلانات التجارية قد تتجاوز حدود المنافسة المشروعة ومن ثمة تنشأ منازعات حول مدى مشروعية الإعلانات التجارية من عدمها وهل ساهمت هذه الإعلانات التجارية في تضليل المستهلكين وما هي الوسائل الكفيلة التي نحمي بموجبها المحلات التجارية المنافسة وجمهور المستهلكين من آثار هذا التضليل الممارس. The advertising business is nowadays one of the means of competition and is the most prevalent known by the consumer. It is most widely used by companies when promoting their products. Commercial ads are non-personal means that assume the provision of goods and services to the market in order to achieve profitability goals and the ambitions of the greatest possible efficiency. But the undeniable reality that the commercials may exceed the limits of legitimate competition whereby arise disputes about the legality of the commercials and whether these commercials contribute in misleading consumers. What are the means likely to ensure the protection of competing shops and consumers from the effects of this misinformation practices.
