التدابير الوقتية في مسائل الأسرة في ضوء تعديل قانون الأسرة الجزائري

Résumé: فرملخص: فرض قانون الأسرة رقابة القاضي وذلك من خلال استحداث المادة 57مكرر المتعلقة بالتدابير المؤقتة التي يمكن اتخاذها بناءا على الأوامر على العرائض. وهذا من أجل تفعيل دوره في حماية الأسرة والطفولة والسعي للحفاظ على كيان الأسرة ومنع تشرد الأطفال، والإسراع في حسم دعاوى النفقة و الحضانة والزيارة الوقتية و السكن بأسرع وقت ممكن لضمان حقوق الزوجة والأطفال. والسؤال الذي يطرح نفسه : مدى التقدم الذي تحرزه التدابير المؤقتة المستحدثة بالمادة 57 مكرر والمتخذة من طرف القاضي في مسائل الحضانة و النفقة و الزيارة و المسكن المؤقتة في المحافظة على استقرار الأسرة وتعزيز مكاسبها؟ وكيف تعامل الجهاز القضائي مع النزاعات المرتبطة بها؟ و هل هي واردة على سبيل الحصر أم المثال؟. الكلمات المفتاحية: أوامر أسرة نفقة حضانة موقتة تدبير مؤقت . Abstract: Imposing family law judge control through the introduction of article 57 bis concerning temporary measures that can be taken based on orders on Petitions. This is in order to activate its role in the protection of the family and childhood and strive to maintain the family structure and child homelessness prevention and rapid resolution of claims of alimony and temporary custody and visitation and residence as soon as possible to guarantee the rights of the wife and children. And the question arises: The extent to which the interim measures established in Article 57 bis, which have taken place in matters of custody, maintenance, visitation, and temporary housing, contribute to maintaining the stability of the family and enhancing its gains? How did the judiciary deal with the conflicts associated with it? And is it merely an example?. key words: Temporary custody orders the entire expense of an interim measure.
