الضبط الإداري والرقابة القضائية على حقوق وحريات الأفراد

Résumé: إن المحافظة على النظام العام في الدولة في ظل الإفراط من بعض المواطنين في استغلال الحياة بصفة مطلقة و دون ضوابط حتى صار الأمر ينقلب إلى ضده ,أدى إلى ضرورة وجود سلطة مختصة تعمل على تحقيق أغراض الوظيفة الإدارية في الدولة سميت بالضبط الإداري أو البوليس الإداري لضبط الحريات حتى لا يساء استعمالها من اجل المحافظة على النظام العام. ونظرا للعلاقة التبادلية التكاملية التي تربط بين سلطات الضبط الاداري والحريات العامة فلاحرية الا بالنظام ولانظام الاّ بالحرية،وجبت الموازنة بين سلطات الضبط الاداري والحريات العامة فلا وجود لحرية مطلقه ولا لسلطة ضبط مطلقة، فسوء استخدام الحرية يؤدي بدون شك الى الاضطراب والفوضى كما ان رجحان كفة سلطات الضبط الاداري يؤدي الى الاستبداد والجور على الحريات العامة. ولا يمكن تحقيق هذا التوازن الا بالأعمال الفعلي لجملة من الضمانات التي اقرها التشريع الجزائري والتي من ابرزها فرض رقابة خاصة في ظل الظروف التي تتزايد فيها صلاحيات سلطات الضبط الاداري وتتسع بما يمكنها من السيطرة على الاوضاع و اعادت الامور الى نصابها. كما ان اقرار مسؤولية سلطات الضبط الاداري عن مختلف الاضرار التي تحدثها يشكل صمام امان في وجه تلك السلطات. وكل ذلك حتى لا تنحرف عن هدفها الاصيل. يتناول هذا الموضوع زوايا مهمة وجوانب محتمة الدراسة للضبط الاداري اذ تطرقنا فيه الى التعريف بالضبط الاداري وتحديد أقسامه ( الضبط الاداري العام والضبط الاداري الخاص ) ،ووسائله المتمثلة في لوائح الضبط ،والقرارات الفردية ،والتنفيذ الجبري . الكلمات المفتاحية : الضبط الاداري ،النظام العام ،حقوق ،حريات ،الرقابة Abstract: Maintenance of public order in the state in light of the excess of some citizens in the exploitation of life in general and without control until the issue becomes until the existence of an authority competent working for administrative purposes in the state called the administrative or administrative police to control freedoms so as not to abuse them in order to preserve the general system. Offices of public control, authority of absolute control, authority of absolute control, the diversion of freedom undoubtedly leads to confusion and chaos in the authorities of public control, which leads to the tyranny and injustice of freedoms. This balance between administrative control authorities and public freedoms can only be achieved through the effective work of a set of guarantees approved by Algerian legislation, the most important of which is the imposition of a special control in the light of circumstances in which the powers of the administrative control authorities multiply and expand to enable them to control the situation and restore the normal situation. Also, establishing the responsibility of the administrative control authorities for the various damages caused by them constitutes a safety valve vis-à-vis these authorities. All this so that it does not deviate from its initial objective.
