دلالة الاقتران عند المالكية دراسة أصولية فقهيه

Résumé: "تتناول هذه الدراسة موضوع ""دلالة الاقتران عند المالكية"" من منظور أصولي فقهي، وتهدف إلى الإجابة عن الإشكالية الجوهرية: ما مدى حجية دلالة الاقتران عند المالكية؟ حيث تم تقسيم الدراسة إلى مبحثين رئيسيين: الأول تعرّف فيه الباحث دلالة الاقتران وأقسامها ومدى حجيتها، والثاني تناول التطبيقات الفقهية التي اعتمد فيها علماء المالكية على دلالة الاقتران. توصلت الدراسة إلى أن علماء المالكية لم يعتمدوا على دلالة الاقتران بشكل مطلق، بل عملوا بها في بعض المواضع فقط، وغالبًا ما تحتاج إلى قرينة إضافية لتثبيت الحكم، مما يجعلها من الأدلة الاستئناسية وليست القطعية. كما عرضت الدراسة نماذج تطبيقية متنوعة توضح قوة وضعف دلالة الاقتران في استنباط الأحكام عند المالكية. أوصت الدراسة بضرورة الاستفادة من دلالة الاقتران ضمن سياق الاجتهاد الفقهي، مع مراعاة وجود أدلة إضافية تدعمها، لما لها من أثر عملي في فهم الفقه المالكي وتطبيقاته. "This study addresses the topic of ""The Significance of Conjunction (Dalaalat al-Iqtirān) in the Maliki School"" from a jurisprudential and usul (principles of Islamic jurisprudence) perspective. It aims to answer the fundamental question : To what extent is the indication of conjunction authoritative according to the Maliki school? The study is divided into two main sections : The first defines the concept of conjunction indication, its types, and the degree of its authority. The second section examines the jurisprudential applications where Maliki scholars relied on the indication of conjunction. The study concludes that Maliki scholars did not rely on the indication of conjunction absolutely; rather, they applied it only in certain cases, often requiring additional evidence to confirm the ruling. This makes it a supplementary (istinasiyyah) rather than definitive (qat'iyyah) proof. The study also presents various practical examples illustrating the strengths and weaknesses of conjunction indication in deriving rulings within the Maliki school. The study recommends benefiting from the indication of conjunction within the context of juristic ijtihad, while taking into account the presence of supporting evidence, due to its practical impact on understanding Maliki jurisprudence and its applications.
