مظاهر الحماية القانونية لوسائل الدفع الإلكتروني في التشريع الجزائري

Résumé: ملخص: تعد التجارة الإلكترونية من أهم التغيرات التي شهدها العالم خلال السنوات الأخيرة، فبتطور تكنولوجيات الإعلام والإتصال أصبح اعتماد المبادلات التجارية الإلكترونية في الجزائر ضرورة حتمية لابد منها، وهذا بفضل اعتماد البنوك ومختلف المؤسسات المالية لنظم الدفع الإلكترونية في معاملاتهم المصرفية التي تتميز بالسرعة والكفاءة من حيث التبادل المالي الإلكتروني، إلا أنها قد تتعرض لخطر قرصنتها والإعتداء على البيانات والمراسلات الشخصية للمتعاملين إلكترونيا، ونهدف من خلال هذه الدراسة إلى توضيح الحماية القانونية المكرسة لعملية الدفع الإلكتروني، وهذا عن طريق اعتماد التوقيع والتصديق الإلكترونيين، باعتبارهما من أهم الآليات القانونية التي توفر أمن المعاملات الإلكترونية ومختلف بياناتها وتوفر الثقة لدى مستخدمي وسائل الدفع الإلكتروني، والتي نظمها المشرع الجزائري بموجب القانون رقم 15-04. Abstract: E-commerce is one of the most important changes that the world has witnessed in recent years, With the development of information and communication technologies, the adoption of electronic trade exchanges in Algeria has become an absolute necessity, this is thanks to the adoption of electronic payment systems by banks and various financial institutions in their banking transactions, which are characterized by speed and efficiency in terms of electronic financial exchange. However, it may be exposed to the risk of hacking and attacking the data and personal correspondences of electronic dealers, Through this study, we aim to clarify the legal protection devoted to the electronic payment process, by adopting electronic signature and ratification, As one of the most important legal mechanisms that provide the security of electronic transactions and their various data It provides confidence to users of electronic payment methods, which were regulated by the Algerian legislator under Law No. 15-04
