ضمان حق حرية المعتقد في المواثيق الدولية

Résumé: الملخص: يتمتع الفرد بحريات أساسية، ومن بين هذه الحريات نجد حرية المعتقد، وهذه الأخيرة تتعلق بشخص الإنسان، إذ أن كل أفكاره ومعتقداته نابعة من ضميره، وهذا ما يمثل حرية الفرد في اختيار عقيدته وممارسة شعائره الدينية التي تتمتع بالحماية. وأن حرية المعتقد في القانون الدولي لحقوق الإنسان، تعد من بين الركائز الأساسية التي تحقق الأمن البشري، وتؤثر على سلامة وديمومة الكيان الذاتي للأفراد خاصة، والجماعات عامة، ويعتبر مفهوم حرية المعتقد عنصر مهم للتعبير عن الذاتية الثقافية، وهو أكثر المواضيع حساسية وصعوبة من قضايا القانون الدولي الأخرى، بحيث أقرته مختلف التشريعات الدولية سواء كانت عالمية أم إقليمية، على أن تمارس في حدود النظام العام والآداب العامة، دون المساس بحقوق وحريات الآخرين. Abstract : The individual enjoys basic freedoms, and among these freedoms we find freedom of belief, the latter of which relates to the human person, as all his thoughts and beliefs derive from his conscience, and this is what represents the freedom of the individual to choose his belief and practice his religious rites that enjoy protection. And that freedom of belief in international human rights law is among the main pillars that achieve human security, and affects the integrity and permanence of the self-entity of individuals in particular, and groups in general. Other international organizations, as approved by various international legislations, whether global or regional, provided that they are exercised within the limits of public order and public morals, without prejudice to the rights and freedoms of others.
