الوقاية من التمييز وخطاب الكراهية قيد آخر على حرية الرأي والتعبير في الجزائر

Résumé: ظهرت في الجزائر مؤخرا بوادر لخطابات التمييز والكراهية؛ على أساس ديني أو عرقي أو جهوي، مما استدعى اصدار قانون رقم 20-05 للوقاية من التمييز وخطاب الكراهية، في محاولة لمواكبة التشريع الدولي في هذا المجال، غير أن المراقبين يرون في ذلك خطورة حقيقية على حرية الرأي والتعبير، إذا لم تتوفر الضمانات الكافية لتطبيقه، ومن أهم ما توصلنا إليه في هذا المقال، ضرورة إسناد مراقبة تلك الخطابات إلى جهة مستقلة عن الدولة، مع توفير مزيد من الضمانات القانونية التي تساعد على التفرقة بين حرية التعبير وخطاب الكراهية. Abstract: Signs of discrimination and hate speech have recently appeared in Algeria; On a religious, ethnic or regional basis, which necessitated the issuance of Law No. 20-05 for the prevention of discrimination and hate speech, in an attempt to keep pace with international legislation in this field, however, observers see this as a real threat to freedom of opinion and expression, if sufficient guarantees are not available for its implementation And one of the most important things we have reached in this article is the necessity to entrust the monitoring of these speeches to an agency independent of the state, while providing more legal guarantees that help differentiate between freedom of expression and hate speech.
