بنية الاستحسان في نسق الجدل الأصولي

Résumé: تناول هذا البحث دراسة الاستحسان من خلال بنيته في علم أصول الفقه، على ضوء جدلية تبحث كونه دليلا مستقلا أو طريقا من طرق الترجيح، وهذه الإشكالية على قوتها كانت حاضرة في البحث وإن لم يناقشها استقلالا، من خلال استعراض أقوال علماء الحنفية وميلهم إلى كونه دليلا مستقلا، يصلح أن يكون آلة استمداد للحكم الشرعي. لقد حاول البحث أن يرسم العلاقة الوطيدة بين الاستحسان والجدل الأصولي، من خلال عرض مستوف لآراء علماء المذاهب، ومعرجا على المصالح وأثرها في وجود الاستحسان، مع بيان العلاقة الجدلية بين الاستحسان والقياس وما أثر عنهما من مباحث ونقاشات بين العلماء. Abstract This research dealt with the study of praise through its structure in the osol alfiqh, in the light of dialectic looking to be an independent guide or a way of weighting, and this problem of its power was present in the research and not discussed by independence, only through the review of the scholars and their tendency to be independent evidence , Fit to be a machine to draw the forensic rule especially with regard to contemporary doctrinal issues. The research sought to draw the close relationship between the approval and the purposes of Islamic law, since all kinds of approval was intended to take into account the purpose of the street and if the measure contravened the apparent apparent consequences of the consequences. This study was carried out with examples of present calamities that represent the need to pay attention to the research of praise in contemporary Ijtihad.
