شرعية السلطة بين الانتخاب والرضاء الشعبي

Résumé: المستخلص غدت حياة الناس شاقة في أغلب الأقطار العربية بسبب الصراع على السلطة، والتدخلات الأجنبية، والفساد وتزوير الانتخابات، والاستحواذ المطلق على السلطة والارهاب والحروب الطاحنة والكوارث والأزمات، والاحتجاجات الداخلية المخلة بالأمن والنظام العام – والألم يعتصر قلوبنا – بأننا نفتقر إلى استقرار العلاقة بين الشعب والسلطة. لما كان الانتخاب إجراءاً ديمقراطياً للوصول إلى السلطة في انتخابات حرة ونزيهة، لذا يمكن القول بأنه أولى الخطوات نحو الديمقراطية، وذلك لأن الديمقراطية ليست في الوصول إلى السلطة بصناديق الاقتراع فحسب . بل أن ألأهم من ذلك كله في الممارسة الديمقراطية ما بعد تولي السلطة، أي ديمقراطية الاستمرار بالسلطة "شرعية الانجاز" وهو ما يمكن أن يطلق عليه الرضاء الشعبي من قبل المحكومين على السلطة. فالانتخابات هي ليست العنصر الوحيد لشرعية السلطة فقط، وإنما شرعية السلطة منبعها الرضاء الشعبي، فالشرعية صفة يجب أن تلازم أي نظام سياسي من أجل ممارسة السلطة والاستمرار بالحكم ، وهي تقوم على جانبين ، يتمثل الجانب الأول في "الجانب الشكلي المتمثل بالشرعية الدستورية أي إقامة السلطة وممارستها وفق أحكام الدستور والقانون" . أما الجانب الآخر فهو "الموضوعي تعزيز للشرعية الدستورية المتمثل بقناعة ورضا الشعب بالسلطة وهذان الجانبان لا ينفصلان عن بعضهما". الكلمات المفتاحية: شرعية السلطة ، الانتخابات ،الرضاء الشعبي ،الشرعية الدستورية. Abstract People’s lives have become difficult in most Arab countries because of struggle for power, foreign interventions, corruption, electoral fraud, absolute seizure of Authority, terrorism, wars, disasters and crises, and internal protests that disrupt security and public order - and the pain in our hearts - that we lack the stability of relationship between the people and the authority. Since the election is a democratic procedure to gain power in free and fair elections, so it can be said that it is the first step towards democracy, because democracy is not only about access to Authority through the ballot box Rather, most important of all in the democratic practice after taking Authority, that is, the democracy of continuity in Authority, “the legitimacy of achievement,” which can be called popular consent by those who are governed by Authority . Elections are not the only element of the legitimacy of the authority only, but legitimacy of the authority stems from popular consent. in accordance with the provisions of Constitution and the law. As for the other side, it is "objectively a strengthening of constitutional legitimacy represented by the people's conviction and approval of authority, and these two aspects are inseparable from each other."
