مسٶولیه رئیس الجمهوریه السیاسیه امام البرلمان فی النظام الدستوری الجزائری والنظام الدستوری التونسی

Résumé: ملخص: تتبنى معظم الأنظمة السياسية المعاصرة، مبدأ عدم مسؤولية رئيس الدولة سياسيا أمام الهيئات التشريعية، وفقا لمبررات عديدة تختلف نتائجها، باختلاف طبيعة النظام السياسي المتبع، ولعل من بين هذه الأنظمة السياسية نجد النظام السياسي الجزائري الذي كرس في معظم دساتيره، باستثناء دستور 1963، تطبيقات هذا المبدأ، وبدوره كرس النظام السياسي التونسي لذات المبدأ في الدستور السابق لسنة 1959 وتعديلاته، و في الدستور الحالي لسنة 2014؛ وقد استند كلا النظامين، على أسس هامة وسعت من عدم مسؤولية رئيس الجمهورية سياسيا أمام البرلمان، و هي الانتخاب المباشر من طرف الشعب للرئيس ، ومركز هذا الأخير ودوره كضامن لوحدة الأمة والدولة ودوره كضامن لاستمرارية الدولة، غير أن ذلك يتوقف على دور الرئيس أيضا في مدى ممارسته لحجم السلطة التي يتمتع بها، وبالتالي مدى تحقيق التوازن بين ممارسة هذه السلطة و مسؤوليته السياسية عنها. الكلمات المفتاحية: عدم المسؤولية السياسية، رئيس الجمهورية، النظام الدستوري الجزائري، النظام الدستوري التونسي، البرلمان. Abstract: most contemporary political systems, adopt a principle of the political irresponsibility of the head of state before the legislative bodies, according to many justifications for the results differ, according to the nature of the practice of the political system, and possibly to be among these political systems, one finds the Algerian political system, which has consecrated most of their constitutions, with the exception of the 1963 Constitution, the applications of this principle, and in turn, it has consecrated the political system the same principle, in the old Constitution of 1959, as amended, and in the current Constitution of 2014, the two systems were based on important principles have contributed to the expansion of the irresponsibility of the President of the Republic on the political plan before the Parliament, It is the direct election by the people to the p resident and the status of the latter and its role as guarantor of the unity of the nation and state and its role as a guarantor of the continuity of the state, but that depends on the president also played a role in the extent of the exercise of the volume of power of which enjoys, and thus the achievement of a balance between the exercise of this power and political responsibility.
