المدونة النوازلية في مواجهة الآفات الأسرية بالأندلس - نوازل ابن الحاج التجيبي أنموذجا- The Blog Of Nawazilia In Confronting Family Scourge In Andalus -nawazil Ibn-alhaje Toujibi As A Template-

Résumé: يتضح لنا من خلال الدراسات والأبحاث الأكاديمية التي تخصصت في التنقيب عن التراث النوازلي المالكي بالغرب الإسلامي، مدى مساهمة تلك المنظومة الفقهية في الضبط العقدي والسلوكي والمعاملاتي لمجتمع الغرب الإسلامي، وتشريح ما اعتراه من آفات، وقد حاول الفقهاء تتبع تلك المسائل المعروضة عليهم بالبحث والتنقيب والإجابة عليها لتنظيمه وحفاظا على مقوماته، ومن تلك النوازل الأندلسية التي وصلتنا "نوازل ابن الحاج التجيبي ت 529هـ/"، والتي جاءت في 783 مسألة رصدت لنا الحالة الاجتماعية والاقتصادية والدينية للمجتمع الأندلسي عصر ملوك الطوائف والمرابطين. من النوازل التي جاءت في مدونته مسائل الأحوال الشخصية للمجتمع الأندلسي، ومنها المشاكل الأسرية التي شكلت حيزا معتبرا من الفتاوى الواردة، والتي جاءت في إطار سياقات تاريخية معينة، يهدف هذا البحث إلى معرفة تلك السياقات التي أفرزت تلك المشاكل والبحث في مظاهرها وتجلياتها وجهود الفقيه ابن الحاج في معالجتها، ومدى قدرة الفقيه في تشكيل منظومة معرفية انبثقت منها منظومة سلوكية فاعلة. It is shown to us by academic studies and research wich specialized in traceability of Maliki nawazili heritage in Islamic west, how far the contributes of system jurisprudence in belief , behaviour and transaction guidance for Islamic west society, study and detail what happened to it from scourges,and the jurists tried to track down the issues presented to them by search and traceability and answer it for organize it and to preserve its foundations, and from those matters that we got “Nawazil Ibn-Alhaj tougibi in 529 H” that came in 783 issue showed us the social, economic and religious status of Andalus society the age of kings of denominations and monotheists . One of the matters that came in his blog issues of personal status of Andalus society ; and from it family problems wich it constituted a significant portion of the fatwas received , wich came within certain historical contexts, this research aims to find out those contexts that caused those these problems and searching for its manifestations and Ibn Alhaj Faqih’s efforts to address it and the ability of the jurist to form a congnitive system, an effective behavioral system came out of it.
