التكييف الفقهي لعمليات استئجار الأرحام (دراسة فقهية تأصيلية)

Résumé: تعالج هذه الورقة البحثية أهم الأحكام الفقهية التفصيلية المتعلقة بتقنيات استئجار الأرحام، التي تعد من أهم طرق الإنجاب الحديثة في العصر الحاضر، حيث تجمع الورقة المقدمة بين التصور الطبي لهذه القضايا وبين النظر الشرعي لها، وقد تناولت فيها أحكام العمليات الإجرائية لتقنيات استجار الأرحام، مع بيان الأسباب والدوافع للدخول فيها، ثم تسليط الضوء على الآثار المترتبة عليها، وانعكاساتها على الفرد والمجتمع، بداية من الطفل المولود وتنازع الأمومة فيه بين الأم البيولوجية (صاحبة البويضة) والأم الحامل، إضافة إلى التنبيه على ظاهرة الاستغلال البشري وتوظيفها في المجال الاقتصادي من أجل تحقيق الثروة والغنى، مما نتج عنه ظهور شركات عالمية تتاجر بالنساء في بعض دول العالم. Abstract: This research paper deals with the most important detailed jurisprudence rulings related to surrogacy techniques, which is one of the most important modern methods of reproduction in the present era. The reasons and motives for entering into it, then highlighting the implications of it, and its repercussions on the individual and society, starting with the newborn child and the conflict of motherhood in it between the biological mother (the owner of the egg) and the pregnant mother, in addition to alerting the phenomenon of human exploitation and its employment in the economic field to achieve wealth And wealth, which resulted in the emergence of international companies that trade in women in some countries of the world.
