جوانب المرونة في إتفاق تربس كأداة لنقل التكنولوجيا للدول النامية

Résumé: الملخص: لطالما كانت الدول المتقدمة سبّاقة لإرساء أحكام الملكية الفكرية دوليا بما يتناسب مع ظروفها الاقتصادية و الاجتماعية و ذلك من خلال إبرام إتفاقيات و كذا إنشاء منظمات دولية ، أمّا الدول النامية فقد كانت مضطرّة للمصادقة على هذه الإتفاقيات و الإنضمام لهذه المنظمات للإلتحاق بالركب الدولي ، و من بين أهم الإتفاقات الدولية المتعلقة بالملكية الفكرية في يومنا الحالي نجد إتفاق تربس TRIPS المبرم في إطار منظمة التجارة العالمية ، و من خلال مقالنا الحالي طرحنا إشكالية تتمثل في كيف يمكن للدول النامية الإستفادة أقصى الإمكان من إتفاق تربس من أجل نقل التكنولوجيا إليها ؟ . و إجابة هذه الإشكالية كانت بإستقراء مواد إتفاق تربس و إستخلاص كيفية الإستفادة من جوانب المرونة فيه لبناء قاعدة تكنولوجية و تطويرها إعتمادا على الحقوق المخولة لها بموجب الإتفاق ، كحق الإفصاح و حق الإستيراد الموازي و الترخيص الإجباري . Abstract: Developed countries have always been proactive in establishing intellectual property provisions internationally in a manner commensurate with their economic and social conditions , through the conclusion of agreements and the establishment of international organizations , while developing countries were forced to ratify these agreements and join these organizations to join the international community , the most important international agreements related to intellectual property today , we find the TRIPS Agreement concluded within the framework of the World Trade Organization , and through our current article we raised a problem represented in how developing countries can benefit as much as possible from the TRIPS agreement in order to transfer technology to them ?. the answer to this problem iwas by extrapolating the articles of the TRIPS Agreement and deducing how to take advantage of the flexibility aspects in it to build a technological base and develop it based on the rights conferred upon it under the agreement , Such as the right of disclosure , the right of parallel import , and compulsory licensing .
