تسوية نزاعات نقل النفايات عن طريق التحكيم في الاتفاق البيئي العالمي (اتفاقيتي بازل وستوكهولم أنموذجا)

Résumé: لقد أولت اتفاقيتي بازل وستوكهولم المتعلقتين بحماية البيئة من النفايات أهمية كبيرة لتسوية النزاعات عن طريق التحكيم، مما يجعلنا نتساءل حول اجراءات التحكيم واجبة الاتباع لتسوية النزاعات المتعلقة بحماية البيئة؟ ولعل أهم ما استنتجناه، عدم توحيد الاجراءات التحكيمية بين اتفاقيتي بازل وستوكهولم، مع تأكيدهما على ضرورة تفعيل قواعد القانون الدولي ونصوص الاتفاقيتين مهملتان بذلك إرادة الأطراف في اختيار القانون واجب التطبيق على النزاع. The Basel and Stockholm conventions related to the protection of the environment from wastes have attached a great importance to settling disputes through arbitration, which makes us wonder about the arbitration procedures to be followed for settling disputes related to environmental protection? Perhaps the most important thing we concluded was the lack of unification of arbitral procedures between the Basel and Stockholm conventions, with their emphasis on the necessity of activating the rules of international law and the texts of the two conventions, thus ignoring the will of the parties to choose the law applicable to the dispute.
