Résumé: During the settlement of real estate matters, the criminal judge faces the problem of the participation of civil laws in their protection with the criminal law, and here the question arises about the extent and nature of the relationships between the criminal rule that includes the division of duty and the penalty and the criminal rule that includes the matter or the non-criminal legal status, and how does he decide it? Will it follow the concept of these issues in its own laws or according to what is dictated by the rules and goals of the penal law that aim to protect the public interest and not the private interest, and this research raises the problem of duplication of legal protection for one money and defines the concept of legal terms in this case and the extent of independence or dependency of the criminal rule, What is the authenticity of rulings issued by criminal courts before civil courts?
