الإدارة الجزائرية وعقود امتياز الأملاك الوطنية

Résumé: يعتبر قانون الأملاك الوطنية من أهم فروع القانون الإداري، وهذا لارتباطه بثروة المجتمع، لذلك يعتمد عليه المشرّع في دعم عدّة نشاطات في الدولة، ومنها النشاطات الاقتصادية، إلا أنّه كان صارماً في إجراءات تسييرها نظرًا للخطورة التي تتعرّض لها اثناء عملية التسيير هذه، لذلك يحاول المشرّع أن يوازن بين حماية الأملاك الوطنية خاصّة الأملاك الوطنية الخاصّة؛ وبين تثمينها اقتصادياً، لذلك اعتمد على طريقة قديمة وجديدة في نفس الوقت وهي تسيير الأملاك الوطنية عن طريق عقود الامتياز. و استعمال الاملاك الوطنية عن طريق عقود الامتياز هو استعمال خاص لها ،عكس الاستعمال الجماعي للأملاك الوطنية الذي يكون مسموح لكافة الجمهور و الذي يغلب عليه الطابع الاداري. One of the most important branches of the administrative law, is the National Property Law.It is considered so because of its relationship to the society’s wealth. Therefore, the legislator relies onit in supporting various activities in the country, including economic activities, but the legislatorwasstrict in itsManagement procedures seen thatit faces many dangers during this process. So, the legislator tries to balance between the national properties protection- in particular private national properties- and its economic valuation. Thus, he relied onan old-new approach, which is, the management of national properties through concession contracts. The use of national property through concession contracts is a private useof it, in contrast to the collective use of national properties that is permitted to the general public and is predominantly administrative.
