Résumé: لقد تفنن الانسان في توظيف واستغلال التراث الثقافي تحت ظروف سياسية واجتماعية واقتصادية وحتى أمنية، لذلك تعد الجرائم الواقعة على التراث الثقافي من أخطر الجرائم التي تهدد الأمن والسلم الدوليين، كما نجد أن الجرائم المرتكبة ضده غالبا ما ترتبط معها ممارسات غير قانونية مثل تهريب المخدرات وغسيل الاموال وتزوير المستندات وارتكاب جرائم إلكترونية. خلال العقد الماضي، شهد العالم ارتفاع الهجمات الارهابية على التراث الثقافي خاصة على الدول التي تشهد نزاعات مسلحة، فضلا على النهب المنظم والمتاجرة غير المشروعة بالممتلكات الثقافية على نطاق غير مسبوق. وهذا ما دفع بالمجتمع الدولي إلى المطالبة من أجل التعاون لحماية التراث الثقافي وملاحقة من يعرضه للسرقة والفقدان. Humans have exploited the cultural heritage under political, social, economic and even security conditions; Therefore, the crime against cultural heritage are among the most serious crimes that threaten international peace and security, and we often find that crimes against him are linking with illegal practices, such as drug smuggling, money laundering, falsification of documents and Cybercrime As in the last decade, the world has witnessed a sharp increase in terrorist attacks on, and destruction of, the cultural heritage of countries affected by armed conflict, as well as organized looting, illicit trafficking of cultural objects on an unprecedented scale. This is prompted the international community to demand cooperation in order to protect the cultural heritage and to prosecute those who expose it to theft and loss.
