انعكاسات نظرية "الخطأ الربحي" على مسؤولية العامل القانونية

Résumé: يلتزم المسؤول عن الخطأ بدفع التعويض عما لحق المضرور من خسارة جبرا له، طبقا للقواعد التقليدية في التعويض، إلا أن متطلبات العصر صارت تفترض أن ذلك لم يعد كافيا ، و غير متناسب مع التطور الفائق الذي شهدته المسؤولية المدنية باستحداث الأخطاء العمدية "ذات الصفة الربحية"، بحيث أنه لم يعد كافيا جبر الضرر عن الخسارة و إنما وجب إلى جانب ذلك ردع المخطئ من إتيان الخطأ في المستقبل بما صار يصطلح عليه بنظرية الخطأ الربحي. و عليه سوف نحاول من خلال دراستنا هته شرح مفهوم هذه النظرية على صعيد المسؤولية المدنية بصفة عامة ، ثم التركيز على آثرها و انعكاسها على المسؤولية في علاقات العمل بين رب العمل و العامل المخطئ خطئا ربحيا. الكلمات المفتاحية : الخطأ الربحي؛ الضرر ؛المسؤولية ؛ العامل ؛ التعويض العقابي؛ حجم ربح العامل. Abstract: It is committed that the head of the fault pays compensation to compensate for the injury of the victim, according to the traditional rules of compensation, but the requirements of the time are supposed that this is no longer sufficient and that it becomes disproportionate with the development which has known civil liability recently by integrating the intentional "lucrative vocation" faults, so that they are insufficient to just repair the damage to the loss and, in this case, a deterrence of the error has been made to the future whose theory of lucrative fault is now called. We will try by this study to explain the concept of this theory in the light of responsibility in general, then we will focus on its impact and reflection on the responsibility for working relations between the employer and the worker fault of lucrative fault.
